Contracting Regime

The Caribbean Energy Generator and Marketer – GECELCA is a mixed public services company, whose applicable legal regime in contractual matters is that provided for in Law 142 of 1994. Therefore, its acts and contracts are governed by private law (Judgment C-736 of 2007).

By virtue of the above, the contracting regime applicable to the company is private law, and it is not subject to the state contracting regime provided for in Laws 80 of 1993 and 1150 of 2007. Therefore, it has its own Contracting Regulations, which are in accordance with the principles of the administrative function and fiscal management dealt with in Articles 209 and 267 of the Political Constitution.
